Welcome to Wearify, an AI-powered virtual try-on application ("App") owned and operated by Maksymilian Mogilski ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, please do not use our App.

2. Acceptance of Terms

By accessing and using Wearify, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this App's particular services, you shall be subject to any posted guidelines or rules applicable to such services.

3. Description of Service

Wearify is an iOS application that allows users to upload photos of themselves and clothing items from online stores to generate AI-powered virtual try-on images. The service uses artificial intelligence to create realistic representations of how clothing items might look when worn by the user.

4. User Responsibilities

You are solely responsible for your actions while using the App. This includes but is not limited to:

• Ensuring you have the right to upload and use any photos you submit
• Using the App in compliance with all applicable laws and regulations
• Not using the App for any illegal, harmful, or inappropriate purposes
• Respecting the intellectual property rights of others
• Not attempting to reverse engineer, hack, or compromise the App's security

5. Limitation of Liability

WE DO NOT TAKE ANY RESPONSIBILITY FOR USERS' ACTIONS DONE IN THE APP. You acknowledge and agree that:

• You use the App at your own risk
• We are not liable for any damages, losses, or issues arising from your use of the App
• We make no warranties about the accuracy, reliability, or quality of the AI-generated images
• We are not responsible for any decisions you make based on the virtual try-on results

6. Intellectual Property

All rights, title, and interest in and to the App, including all copyrights, are owned by Maksymilian Mogilski. The App is protected by copyright laws and international treaty provisions.

7. Refunds

We reserve the right to reject any refund request without providing a response or explanation. All sales are final unless otherwise required by applicable law.

8. Data Collection

The App collects user photos and other data as described in our Privacy Policy. By using the App, you consent to such data collection and processing.

9. Data Removal Requests

Users may request total data removal. We have up to 365 days to respond to such requests. We reserve the right to reject data removal requests without providing a response or explanation.

10. End User License Agreement (EULA)

10.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS device solely for your personal, non-commercial use.

10.2 License Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any commercial purpose without our written consent

10.3 Termination

This license is effective until terminated. We may terminate this license at any time without notice if you fail to comply with any term of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
